Any violation by the CLIENT of the Terms and Conditions described herein entitles “LOMIOPRIMERO” to immediately cancel or suspend your account—without prior notice and without liability of any kind—for any reason. Furthermore, such a violation constitutes conduct subject to sanctions ranging from civil to criminal liability.

Returns and Refunds Policy

The CUSTOMER has the right to cancel the purchase prior to receiving the order by providing notification via the available contact channels within 24 hours. Products must be returned in perfect condition. The refund will be processed within seventy-two (72) hours of receipt of the returned items.

Purchase restrictions

“LOMIOPRIMERO” reserves the right to indefinitely block any CLIENT detected attempting to violate our restrictions.

“LOMIOPRIMERO” reserves the right to reject or cancel, for legitimate reasons, any Order where the number of products, the amount payable (whether for a single Order or multiple accumulated Orders), or other elements clearly indicate that the CLIENT is not a consumer, or demonstrate that the CLIENT is engaging in economic activity related to the products ordered, or—in general—any Order not authorized under the laws applicable at the purchase destination.

Should “LOMIOPRIMERO” be held liable for damages suffered by the CLIENT that are attributable solely to the execution of an order, such liability shall be limited to the amount actually paid by the CLIENT for said order.

To the maximum extent permitted by applicable law, in no event shall “LOMIOPRIMERO” or its suppliers be liable for any special, incidental, indirect, or consequential damages of any kind (including, without limitation, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy arising from or in any way related to the use of or inability to use the service, third-party software and/or hardware used with the service, or otherwise in connection with any provision of these Terms), even if “LOMIOPRIMERO” or any supplier has been advised of the possibility of such damages, and even if a remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages; therefore, the above limitations may not apply. In these locations, each party's liability shall be limited to the maximum extent permitted by law.


Anti-fraud control

“LOMIOPRIMERO” maintains a zero-tolerance policy regarding any form of fraud, as a fundamental principle to ensure a secure shopping environment for our CUSTOMER.

“LOMIOPRIMERO” reserves the right to suspend or cancel the processing and delivery of an order—regardless of its nature or stage of fulfillment—in the event of actual or attempted fraud.

The CUSTOMER’s order may be delayed for anti-fraud screening. It may also be suspended for a longer period to allow for a more thorough investigation and to prevent fraudulent transactions.

The CUSTOMER and/or recipient is advised that they may face legal action regarding claims initiated due to fraud-related chargebacks.

As part of efforts to combat online fraud, data related to the CUSTOMER’s order may be shared with third parties authorized by law or designated by “LOMIOPRIMERO” for the sole purpose of verifying the CUSTOMER’s identity, as well as the validity of the order, the payment method used, and the scheduled delivery.

Applicable law and jurisdiction

The Terms and Conditions set forth herein shall be subject to the laws of Canada in force regarding this matter. Any dispute, agreement, or mediation shall be resolved within the Canadian legal system.

Penalties

Neither “LOMIOPRIMERO” nor its affiliates or directors are, to the best of his knowledge, controlled by any person and/or entity currently subject to sanctions administered by the United States of America, the Department of the Treasury’s Office of Foreign Assets Control (“OFAC”), the United Nations Security Council, the European Union, or any other relevant and validly recognized sanctions authority.
